Reversing up the drive as usual and the dutton sierra bites my dutton and this is the result sierra 1 phaeton 0

I have all the spare back issues along with all my own copies from 2000 onwards. I'll have a look to see if I can find the article.

Failure has been documented several times in Dutton torque maybe 12/15 years ago I have all the old mags but im 300 miles away from them was also an article with pictures of one owners repair/uprate

Pretty sure Piers or Mark or if you can contact him Dave Hemmingway could give you more info

MY sister in law met my brother in law via work when she worked for Adrian flux back in the day when they were based in the centre of Kings Lynn and he ran a recovery company its actually one of his wagons my boy is pictured on in the only picture in my profile

Have been helping him out for years every now and then just for fun and done plenty of recoveries for the police , once to the vehicle investigation unit, several time to the naughty boys compound (no tax/insurance) or mostly the recovery yard or owners home.

Look forward to hearing the full story once the dust has settled

it is of concern to all of us steve in a roundabout sort of way, if the old bill can impound vehicles which were third party victims of accidents and prevent the owner from legitimately retrieving their property that seems a little heavy handed. if it is something to do with it being a kit car that is also worthy of interest.

the questions i have asked of police men who i was at school with, give answers that show they are as perplexed as we all are, they think there is no way the police can insist on crushing the car as they have no interest in doing so. they also advise liaising with insurance company asap.

The only reason given to me for the impounding of the car, was that it was it self was not insured. and they wont release a car from such a seizure unless insurance can be proved, i assume your friend Daniel was insured?

Like Rob, I'm just trying to help Daniel. I don't profess to be any sort of lawyer Steve, I know people who are very successful lawyers who would say the same thing. I've been through a similar experience and it was harrowing to say the least. Daniel isn't a club member or a member on here yet still people are coming forward to try and help in anyway they can. Says something about the Dutton owning community.

I'm sure that you are doing everything you can to help Daniel and if there is anything we as a community can do in addition just ask.

well since im only trying to help a fellow owner I would be happy if you could post a link to what part of the rd traffic act the car has been held under ?

Any other links towards the operation of the insurance system and its working  to correct any mistakes I have made ?

Spent nearly a year working with traffic police,  I work in F1and we use speed traps when we go testing,The police evaluated our system (we can do sector times, speed and braking and multiple cars in one go)we also evaluated their system,was a very interesting year to say the least !!! nice to be on the other side of the speed trap.One thing I did learn from that year was not all traffic officers are brilliant to say the least. Some very talented guys an some right muppets just out for the easy nab and fast track promotion

So don't be sure the law know the law weather its an ass or not its that simple

It's Daniel with the Melos, I've on the way sorting mine with spare front. I'm sure Daniel would be interested in the body and parts I would be if this happened to mine it's bad enough tearing the front bodywork.

Listen to what Adrian said a few hours ago ,it dosent matter what the police or the insurance company say or what anyone else may say its the owners car and NOTHING can be done without his say so,

The failure of front leaf spring mounts on the s3 and early s4 is a well documented failure (even in normal every day use without the help of collision damage) ,Duttons weld may not be pretty but its strong. There is a design flaw thou and the stress loadings/flex cause the welds/joint to fail its an area that if you own one of the said cars you should keep an eye on or even better brace.

The police will of had their approved contractor recover the vehicle which has to be paid for, some forces will charge for storage in a police compound others wont. Cant see why the car has gone to a police pound as it dosent matter what or how an item or weld has failed during a crash its only if that failure caused the crash that the police should impound.

As soon as the police have finished with the car the owner can remove it to where ever he wants (do it yourself or get quotes,nearly every quote will be better than the "approved" contractor !

If they haven't inspected the car already while at the police compound then the insurance company  can do it where ever YOU choose to store the car. its getting rarer now to be able to buy salvage back as most insurance companies have "approved" contractors for this too ! (just google copart and see how many cars are on there)

If you are faced with a company that wont let you buy the salvage then you just tell your company that you are not going to proceed with a claim and the car remains yours.(this dosent affect any third party cover that's art of your policy its just the car part of the policy) Then its up to you to proceed with a civil claim against the other driver for your losses i.e damage to the car ,recovery costs, storage costs etc (surfboards !)

Would be inclined to fight the removal to the police compound if the force is one that charges since if the accident did happen as stated there is no need to inspect the Dutton

Times and incidents like this when it pays to take of the option of the legal protection the insurance companys offer you !

its not the old bills choice either, its down to the insurance company and the insured. also you can ask the insurance company not to write off the car, you are also as far as i am aware able to asses your own car for damage if you plan to undertake the repairs your self. (this is always the best option for a kit car)

stress to the insurance company you do not want the car written off (mine should have been) they will negotiate with you.

you can also request that it is moved to a secure location for assessment and repair (your own garage) as i did.

Surely they can't just crush the car? I can understand that, if the car gets walloped on one rare wheel, then the impact would be taken by the fixing at two ends of the leaf spring. But you don't crush a 'classic', you just buy it back from the insurers and repair it.

i note with interest that your car is liveried up in JPS colours, when i used to ride motorbikes years ago you could get the cigarette companies to pay for the art work (sponsorship) since advertising is now very difficult for the cig companies you may well find them very receptive to paying for the damage to be out right.

it would definitely be worth a punt.....send pictures of your car and explain how long its been i those colours, i would be surprised if they dont come up with an offer of some sorts. (even if its just for the respray and new decals)
